These Terms and Conditions apply to the agreement between you (referred to as "You" or the "Customer") and CheapFlightSavers (referred to as "CheapFlightSavers," "We," or "Us"), who operates the booking website at CheapFlightSavers.com (referred to as the "Portal"). Please read these Terms and Conditions carefully before using the Portal. By accessing and using the Portal, You accept and agree to be bound by these Terms and Conditions. If You do not agree with these Terms and Conditions, please leave the website and do not use the Portal.
To make a booking on the Portal, You must be at least 18 years old and acting as a private consumer. A private consumer refers to an individual, rather than a business entity, who engages in a legal transaction primarily for personal, non-commercial, or non-professional purposes.
Provision of Travel Services
Intermediary Role: For flight, hotel, insurance, and car rental services offered on the Portal (collectively known as "Travel Services"), We act solely as an intermediary, connecting You with various Service Providers such as airlines, travel operators, hotels, insurers, car rental companies, or other providers (referred to as a "Service Provider" or “airline” where specifically applicable).
Agreement with Service Providers: The actual agreement for Travel Services (such as transport or insurance contracts) is formed directly between You and the relevant Service Provider. We are neither a co-vendor of the Travel Services nor a party to the contractual relationship between You and the Service Provider.
Responsibility of Service Providers: The relevant Service Provider is solely responsible for the performance of the Travel Services booked through the Portal. We do not assume any liability for the Travel Services to be provided by the Service Providers, and We do not make any express or implied warranties regarding the quality or suitability of the Travel Services available on the Portal. For any claims You may have related to the Travel Service, please contact the responsible Service Provider directly.
Authorization: By using the Portal to purchase Travel Services, You authorize Us to facilitate the transaction on your behalf, including the payment for these Travel Services. The price for the actual Travel Services may include a commission for the services We provide in mediating the agreement between You and the relevant Service Provider.
Special Requests: Should You request specific accommodations or services (such as special meals or child seats) when booking Travel Services, We will communicate your request to the Service Provider. However, We cannot guarantee that the Service Provider will fulfill such requests, and We assume no responsibility for their ability to do so.
Our Own Services
Additional Services: In addition to our Mediation Services, We also provide other services through the Portal for which We are directly responsible. When utilizing these additional services, You enter a direct contractual relationship with Us. We will inform You if and to what extent we offer our own services rather than only mediating third-party services.
Variation and Description: Our portfolio of services may change over time. Some of these services are detailed below. For additional services not outlined in these Terms and Conditions, a comprehensive description, along with information about our fees and supplementary terms for booking and usage, will be provided to You during the booking process.
BOOKING PROCESS AND CONTACT INFORMATION
Error Detection and Correction: During the booking process, You will be given the necessary tools to identify and correct mistakes in your entry forms before finalizing your booking request. It is your responsibility to ensure that all information is accurate before completing your booking request, as subsequent changes may incur significant additional costs.
Provision of Contact Information: We may need to contact You for various reasons, such as changes to the purchased Travel Services. You must provide accurate contact information, including your telephone number and email address, and you must regularly check for messages from Us.
Responsibility for Receiving Messages: You are responsible for ensuring that you can receive our messages. We will not be held responsible if You fail to receive a message from Us due to circumstances reasonably beyond our control, including but not limited to:
- You provided an incorrect email address
- Your email settings prevent our email from reaching You
- Your email settings categorize our email as spam
It is your duty to verify that your email settings will allow for successful communication with Us.
FLIGHT BOOKINGS
Contract Formation and Adjustments to Pricing
Booking Confirmation: Upon submitting your booking request, We will send an email confirming receipt. This confirmation establishes a mediation contract between You and Us. If you do not receive this confirmation within one hour, and no one from our team has contacted you, please call us to verify.
Ticket Issuance: Once the requested tickets are issued, a confirmation email with a ticket number will be sent. At this point, a binding contract with the relevant airline(s) is concluded.
Price and Seat Availability: Airlines add flight prices and seat availability directly to the Portal. If changes beyond our control occur after a booking request (e.g., price changes, seat availability), the contract will not become binding, and your payment will be refunded. We may contact You to offer the changed price during regular business hours within 24 hours of knowledge of the price change.
Guidelines for Booking and Airline Transport Conditions
Mediation Role: We act solely as an intermediary for flight bookings. The contract for the execution of the flight is formed directly between You and the airline, with no contractual responsibility on our part. The airline operating the flight maintains exclusive responsibility for any performance or non-performance related to your flight.
Airlines' Terms: The terms and conditions of the relevant airline(s) will be available before you conclude the booking.
General Information: We provide general information on booking and transport conditions, but always refer to the specific terms of the airline before booking.
Flight Times/Check-In
- Local flight times are given. Changes may occur; keep yourself informed.
- You must adhere to the check-in times specified by the airline. Failure to do so may result in the airline exercising its right to deny you boarding. Charges may apply for manual check-in.
Combination of Tickets
- If your booking consists of two separate one-way tickets instead of a round-trip ticket, this will be indicated during the booking process.
- Separate one-way tickets are treated independently in cases of cancellation, alteration, or change of flight schedules.
- Flight tickets with different booking numbers are independent journeys.
Flight Segment Order of Use
- Follow the sequence of flight segments as specified by the airlines.
- Failure to use one segment of a journey in sequence may lead the airline to deny transport on subsequent flight segments, potentially invalidating the remainder of the ticket.
Special Circumstances
- Pregnancy: Check with the airline and your doctor if travel is permissible.
- Infants and Child Tickets: Contact the airline for specific rules. Children who are over the age of 2 years usually must have their own separate seat.
- Unaccompanied Minors: Children under the age of 18 years must be accompanied by at least one adult.
- Lost/Damaged Luggage: Report to the airline; We bear no liability.
- Connection Times: Ensure sufficient connection time; additional costs will not be reimbursed.
- Double Booking: We are not responsible for cancellations due to double booking.
- Hazardous Materials: Federal law prohibits the transport of hazardous materials. Penalties may apply.
Please note that these terms are a summary, and the individual terms and conditions of the relevant airlines may vary. Always consult the specific airline's terms and conditions for comprehensive and accurate information.
Changes and Cancellation by Airlines
Your contract with the corresponding airline may permit them to amend or cancel your reservations.
If an airline changes the timetable, we will not impose a fee to rebook you according to the airline’s provided alternative. Should the airline cancel, we will also not charge a fee for processing your refund request.
Should an airline alter the timetable or cancel, and you ask us to explore an alternative flight option other than the one already provided by the airline, we will offer to manage the request on your behalf, if the airline’s terms and conditions allow.
Please be aware that the flight times detailed in your booking confirmation may vary between your booking date and travel date. We suggest you contact your airline at least 48 hours prior to the scheduled departure to confirm the flight (and any connecting flights) will leave as planned. We have no control over changes made by airlines and accept no liability for expenses that may arise due to such changes.
Changes and Cancellations Initiated by You
YOU UNDERSTAND AND AGREE THAT, AS A TRAVEL INTERMEDIARY, WE ARE NOT OBLIGATED TO PROVIDE OR OFFER TICKET CANCELLATION OR REFUNDS, EVEN IF REQUESTED WITHIN 24 HOURS OF BOOKING OR ANY OTHER TIMEFRAME. AS A THIRD-PARTY AGENT, WE ARE NOT BOUND BY THE 24-HOUR RESERVATION REQUIREMENT ENACTED BY THE UNITED STATES DEPARTMENT OF TRANSPORTATION.
The specific airline sets the conditions for modifying flight bookings (including passenger name, destination, and travel date) and for issuing cancellation refunds. As an intermediary, we have no authority over these conditions.
If you wish to modify your booking or request a cancellation refund, we may, as an additional service, manage the request on your behalf, if the airline’s terms allow such changes or refunds. We will notify you of any additional conditions for these services during the booking process.
To facilitate the requested changes, please provide us with your request no later than 24 hours before travel (by phone only).
For last-minute changes, we recommend contacting the relevant airline directly.
Non-Appearance or “No Show”
If you fail to appear for or attend your flight, you authorize us to inquire about possible refunds from the airline on your behalf. While we are entitled to do this, we are not required to, and your rights to request unclaimed refunds from the airline directly remain intact.
If we secure refunds for you, our fees will be deducted from the amount retrieved.
Non-Waiver
Under no circumstances shall we be considered to have waived or relinquished any limitation, disclaimer, covenant, condition, or other provision of this Agreement, by offering or providing you any refund, alteration, cancellation, or other concession concerning any Travel Services.
Passport, Visa, and Health Provisions
Passport, visa, and health requirements are subject to change, and it is your responsibility to consult with the appropriate authorities (such as embassies or consulates) well ahead of your travel date. You must possess a valid passport and, if necessary, a visa. Be mindful to include all transit points in your journey, as some may require you to obtain a visa. Obtaining a visa may take time; therefore, it is advisable to apply well in advance. We bear no liability for customers who fail to have the proper documentation.
Entry requirements, vaccinations, and other regulations vary by destination and may also depend on the passenger's nationality. It is solely your responsibility to gather this information. We will not be held responsible for any issues resulting from non-compliance with such official regulations. We strongly encourage you to verify the specific requirements of your destination or any transit countries, as well as the time needed to complete all related procedures.
Payment Processing
Payment Methods and Security: Payment for Travel Services is processed in collaboration with our payment service provider(s). All customer payment information is encrypted and securely transmitted to our payment service provider(s).
Transaction Breakdown: Payment may be divided into two separate transactions, one from us and the other from the Service Provider. You will not be charged more than the total price indicated on our site. Security measures are consistently applied.
Currency Considerations: In certain instances, Service Providers may charge in a different currency than what is displayed on the Portal. We will provide an estimate in the Portal's default currency.
Payment Confirmation: Ensure sufficient funds are available for payment processing. If an issue arises with your payment, we will attempt to retry the transaction and may contact you for alternative payment methods. Unpaid balances may be referred to a debt collection company.
Payment Fraud
Fraud Prevention: We reserve the right to refuse payment processing if fraud is suspected. Verification may be required, and all fraudulent activities will be reported to the appropriate authorities.
Refunds
Refund Processing: Refunds are subject to the terms and conditions of the Service Provider. Refunds, when applicable, will be processed using the same payment method as the initial payment.
Refund Components: Air fares and other Travel Services may include non-refundable components. If you are entitled to a refund as per the Service Provider's policies, the refunded amount may differ from the total price paid for your booking.
Non-Refundable Fees: Our service fees, charged for mediation services, are non-refundable as the services are deemed fulfilled upon booking confirmation. Service Provider add-on products may be refundable if reimbursed to us by the Service Provider. Our own ancillary products are non-refundable.
Refund Timing and Conditions: We act as an intermediary for refunds and have no control over the Service Provider’s processing times. Refunds will only be processed once received from the applicable Service Provider.
Claims Concerning Travel Services
If you have any complaints or concerns regarding the actual delivery of Travel Services, please contact the relevant Service Provider (e.g., travel operator, airline, insurer, car rental company, hotel) directly, as they are responsible for the contracted Travel Service.
USER CONDUCT
You are solely responsible for compliance with all applicable laws related to your use of the Portal. While using the Portal, you must not: Violate any law; Use the Portal for unauthorized purposes; Infringe upon others' rights; Damage the Portal, including through viruses or other harmful technology; Impersonate or misrepresent your affiliation with any person or entity; Attempt unauthorized access to our systems; Circumvent any security or technological measures; or Attempt to modify or reverse engineer the Portal's software.
We reserve the right to limit, suspend, deactivate, or cancel your account, or deny access to the Portal without liability, at our sole discretion.
LIABILITY
We act only as an intermediary between you and the Service Provider, and we have no liability for the Travel Services you book. We're not responsible for any inaccuracies in the information provided by Service Providers on the Portal.
If a Service Provider is unable to provide the Travel Service, we can only refund payments if received from the Service Provider.
For our own services, our liability is limited to direct damages up to the cost of your booking. We're not liable for any indirect, incidental, special, or consequential damages, or for bodily injury or emotional distress. If force majeure events occur, we are exempt from legal responsibility for any deficiencies or non-compliances.
GOVERNING LAW AND DISPUTE RESOLUTION
These terms are governed by the laws of the State of California, USA. You agree that any dispute with respect to these terms or the travel site will be resolved in San Diego, CA, regardless of your residence or place of business.
